This withdrawal policy applies to consumers within the meaning of Section 13 BGB. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity.
For entrepreneurs within the meaning of Section 14 BGB, in particular self-employed persons, freelancers, architecture offices, visualization studios, agencies, or other business customers, there is no statutory consumer right of withdrawal.
Language Version
These legal texts are provided in German and English. In the event of discrepancies, inconsistencies or questions of interpretation between the German and English version, the German version shall prevail. Notice Regarding Polar as Merchant of Record
Polar Software, Inc. acts as Merchant of Record for the purchase, payment processing, invoicing and tax handling. Simsala remains the provider and licensor of Simsala Desktop.
Refund requests: contact info@simsala.co; payment-related processing is handled by Polar Software, Inc. as Merchant of Record.
Use of Simsala Desktop remains governed by our License Terms / EULA.
1. Right of Withdrawal
If you are a consumer, you have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us of your decision to withdraw by means of a clear statement, for example by e-mail or letter.

You may use the sample withdrawal form below, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
2. Effects of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you without undue delay and at the latest within fourteen days from the day on which we receive notice of your withdrawal.
We will carry out the reimbursement using the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged any fees for this reimbursement.
If the refund is payment-related, technical execution is handled by Polar Software, Inc. as Merchant of Record.
3. Expiry of the Right of Withdrawal for Digital Content
Simsala Desktop is provided as digital software / a digital license and is not supplied on a physical medium.
The right of withdrawal expires for contracts for the supply of digital content not supplied on a tangible medium if:
- we have begun performance of the contract,
- you have expressly agreed that we begin performance before the withdrawal period expires,
- you have confirmed that by agreeing you lose your right of withdrawal once performance begins, and
- we have provided you with a corresponding contract confirmation on a durable medium.
Contract performance begins in particular when the download, license key, license activation, or access to the licensed digital content has been provided to you.
If you expressly agree during checkout that Simsala will be provided before expiry of the withdrawal period, and confirm that you lose your right of withdrawal as a result, there is no statutory right of withdrawal once provision has started.

4. Voluntary Refund Policy
Independently of statutory consumer rights, we may offer voluntary refunds in individual cases.
Voluntary refunds may be considered in particular if:
- Simsala cannot run on your system for technical reasons,
- a technical issue cannot be resolved despite reasonable support attempts,
- or you contact us immediately after purchase and the license has not been used materially.
No entitlement to a voluntary refund exists in particular for:
- external AI provider costs,
- costs incurred with Replicate, fal.ai, Runware, or other user-connected AI providers,
- already consumed provider credits,
- abusive use,
- or cases where the software has been duly provided and activated and the statutory right of withdrawal has already expired.
External AI provider costs are not charged by Simsala and cannot be refunded by us.
Payment-related refunds may be technically processed by Polar Software, Inc. as Merchant of Record.
